By using the 28 Mahjong website and/or our Mahjong Room you (“the player”) agree to be bound by our terms and conditions as stated below.

1. LIMITATIONS

The mahjong games at 28 Mahjong are for entertainment only, and your participation in the Games is solely for your own personal enjoyment and not for any business or commercial purpose.
28 Mahjong requires you to be at least 18 years of age, or the legal age of majority in their jurisdiction, whichever is the greater, to play the Real Money Games. Minors may not play at this online Mahjong Room under any circumstances. Any and all play by any ineligible person shall be voided, including any winnings accruing to any ineligible person. We reserve the right to request proof of age at any stage in order to ensure the prohibition of play by minors. Mahjong Real Money games are available only to persons resident in jurisdictions where such participation is legal and not prohibited.
For those under the legal age limit or in jurisdictions where Internet gaming is prohibited, 28 Mahjong has provided a version of Mahjong that can be played for fun, and not for Real Money games, online. If you are under the legal age limit or live in a jurisdiction where Internet gaming is prohibited, you agree that you will only play Mahjong games using the Play for Fun games.

2. PARTICIPATION

Participation at 28 Mahjong is at the sole option, discretion and risk of the player. In particular, determination of the legality of Real Money games play is the player's sole responsibility. By placing real wagers, the player warrants that he/she is legally able to do so within his/her jurisdiction and that he/she accepts that we are unable to provide any warranties as to the legality or otherwise of their participation in real money play.
The player is responsible for the security of his user name, password and personal identification number.
The player will be solely liable for any losses, damages, costs or expenses from the use of his user name, password and personal identification number by others, whether authorized or not.
The player accept and agree to be bound by all bets placed over the Internet in connection with the use of the Mahjong Software at 28 Mahjong, whether by him or by anyone else using his user name and password, whether authorized or not, and that he has no claim against 28 Mahjong of any nature whatsoever relating to any losses arising from or in connection with such bets other than as stipulated in Clause 9 of this Agreement.
The player is solely responsible for supplying his own equipment (which may include a personal computer system, telephone, telephone lines and modem), Internet communications software and operating system software which conform with 28 Mahjong’s standards for use with the Software, and for maintaining the equipment in good working order, all at his own expense. You will only copy and use the Software on a machine at which the player is the primary user. The player represents and warrants that he possesses the necessary skills to operate the equipment and software. 28 Mahjong will not provide support or assistance relating to any hardware or any software other than the Software that enables the player to use the Mahjong Software.
The player is solely responsible for all use of the Mahjong Software through his user name, password and/or personal information number, whether authorized or not. He will not permit others, including but not limited to persons under the age of 18 and/or under the legal age limit, to use the Mahjong Software through your user name, password, and/or personal identification number.
The player will not copy or otherwise distribute the Mahjong Software, and he will be solely liable for any damages, costs or expenses arising from unauthorized copying or distribution.
The player will not reverse engineer, decompile, disassemble, modify, translate, make any attempt to discover the source code of the Software, or create derivative works based on the Mahjong Software, and he will be solely liable for any damages, costs or expenses arising from the above. If 28 Mahjong finds any evidence or has any suspicion that the player has tampered with the Mahjong Software in any way, in addition to any other remedies available to it, 28 Mahjong may withhold payment of your winnings.
The player accept and agree to abide by both the terms and conditions of this agreement, as amended time to time, and the rules of the Mahjong games.
The Mahjong Software utilizes a random number generator software program. The player acknowledges and accepts that its determination of the random numbers for the Mahjong games will be conclusive.
The player acknowledges that if any statement made or information provided by him to 28 Mahjong is untrue or any representations and/or warranties made by him in this agreement are untrue, whether now or at any time that the player places a bet, this agreement will be void, and the player will be liable to 28 Mahjong for any damages and/or costs suffered as a result.
The player accepts that 28 Mahjong will use its best efforts to keep his account confidential, HOWEVER, his participation in Mahjong games will display account balance and username information in a manner that will be viewable by other participants.

3. ELIGIBILITY

If you are an officer, director, employee, consultant or agent of Company or one of its affiliated or subsidiary companies, or suppliers or vendors, you are not permitted to register with 28 Mahjong or to participate directly or indirectly in any of the Games. Any person found to have violated this section will not be entitled to collect any winnings.

4. CASH ACCOUNT, PAYMENTS, DEPOSITS AND BONUS (if any)

The player’s cash account balance is the amount of real money deposited to the player’s cash account to access the Real Money Games, plus or minus any accrued winnings or losses from playing the Games, less any amounts previously cashed out by the player or amounts forfeited or reclaimed by 28 Mahjong. The player may request to cash out and withdraw any or all of his cash account balance at any time and there is no requirement to play the Real Money Games in order for you to make such request. All amounts cashed out are subject to the transaction limits and processing fees as set forth at 28 Mahjong and may change from time to time in 28 Mahjong's sole discretion. Further, 28 Mahjong may report and withhold any amount from winnings as required by law, and in any event, all federal, state and local taxes due in connection with any winnings awarded to you are your sole liability. In no event may cash account balances be transferred, substituted or redeemed for any other prize.
Payment of funds cashed out shall be made by check, wire, credit card and/or any other manner which 28 Mahjong selects in its sole discretion. Payments will be made as promptly as possible, subject to any reasonable necessary security reviews by Company.
To play the Real Money Games, the player will be required to deposit funds into his cash account by any of the methods specified at 28 Mahjong, which may change from time to time in the sole discretion of 28 Mahjong. The player’s funds will be promptly deposited into his cash account upon actual receipt of funds by 28 Mahjong and/or its agents. Minimum and maximum limits apply to deposits depending upon the player’s history with 28 Mahjong, the method of deposit, and other factors as determined solely by 28 Mahjong. All funds will be paid, tracked and maintained in United States Dollars, except as otherwise stated, and shall not bear interest.
Complimentary or bonus amounts (if any) credited by 28 Mahjong into your cash account for promotional purposes may only be used to play in the Real Money Games and you are not entitled to deposit or withdraw such amounts without first complying with the terms and conditions set for promotional offers. Further, 28 Mahjong reserves the right to reclaim any bonus amounts if you do not use them within the period of time specified.

5. FORFEITURE, ACCOUNT CLOSURE AND CONFISCATION

Company reserves the right, in its unfettered discretion, to void any winnings and confiscate any balance in the player’s cash account in any of the following circumstances:

If the player has more than one active account at 28 Mahjong;
If the name on the player’s cash account registration does not match the name on the credit card(s) or other payment accounts used to make purchases at 28 Mahjong;
If the player participate in a promotion at 28 Mahjong and withdraw before fulfilling the requirements of that particular promotion;
If the player provides incorrect or misleading registration information;
If the player is not of legal age;
If the player connects from a jurisdiction where participation in the Games is prohibited by law;
If the player has "charged back" or denied any of the purchases or deposits that you made to your Account;
If the player is found cheating or if it is determined by 28 Mahjong that you have employed or made use of a system (including machines, computers, software or other automated systems) designed specifically to defeat the system;
If the player fails to comply with any of the terms and conditions set forth in this Agreement; OR
If 28 Mahjong should become aware that the player has played at any other online gaming site under any of the circumstances set out at a) to j) above.

6. DISCONNECTION POLICY

Except as otherwise expressly stated in writing by 28 Mahjong, the following terms and conditions set forth the rules and procedures that govern all Player's rights in the event of disconnection and cancellation from a game:

If for any reason a Player loses his/her connection, the game will continue. Tiles will continue to be picked automatically from the wall. After the action time allowed is ended, the tile picked will be discarded automatically. Automatic pick and discard will occur until the end of the game if the player hasn’t reconnected before. A Player should log back on as soon as possible to regain control of the game.
Players MUST accept the risk of disconnection. They can and do occur. (Log back on and continue play as quickly as possible.) To limit the potential of disconnection, please consult with your ISP as to what measures can be initiated to help reduce this risk. At no time will 28 Mahjong assume responsibility for disconnected players regardless of cause.
28 Mahjong reserves the right to alter this policy and render final decisions on all matters herein at its sole discretion. Policy changes and relevant decisions will be communicated accordingly via 28 Mahjong via electronic and/or written means.
Game cancellation policy due to technical issues. In the event of a game being cancelled due to technical issues at 28 Mahjong, each player will be refunded the amount of real cash or free points they staked at the start of the game.

7. PROMOTION TERMS AND CONDITIONS (if any)

The player will credit your account with any promotional credits within one business day. The player is required to play through the credits placed in his account as well as any deposit to cash out his bonus. This can be done by betting in a total of 100 raked hands. This doesn't mean he can't win with his credits, but that the player must meet these criteria before cashing in your winnings. All promotions can only be claimed once per person, household, family, household address, email address, credit card number, or shared computer environment such as a library, workplace, fraternity, university or school. Unless specifically stated otherwise no two promotions can be used in combination and promotions only apply to deposits and wagers on 28 Mahjong’s mahjong software.

8. ABUSIVE OR OFFENSIVE LANGUAGE

Abusive or offensive language will not be tolerated in the multi-player Games or with 28 Mahjong staff. Any violation of this policy will result in a suspension of playing privileges or such other action as may be required by 28 Mahjong to ensure compliance.

9. NO WARRANTIES

28 Mahjong’s mahjong software is provided to you "as is", without warranty of any kind, either expressed or implied, including, but not limited to, implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement. 28 Mahjong does not warrant that the functions contained in the software will meet your requirements, nor that their operation will be uninterrupted and error free. The use quality and performance of the Mahjong software lies with the end user at his own risk.

10. LIMITED LIABILITY

28 Mahjong's maximum liability to you or any third party arising out of this agreement or your use of the Mahjong software, whether for breach of contract or in tort, will be limited to the amount, if any, you paid to access 28 Mahjong’s software. 28 Mahjong will not be liable for any direct, indirect, punitive, special, incidental or consequential damages in connection with or arising out of this agreement or your use of 28 Mahjong’s software (including loss of revenue, profits, data or other economic advantage), however they arise, whether for breach of contract or in tort, even if 28 Mahjong received prior notice of the possibility of such damage.
